1. Acceptance of Terms

By accessing and using the MyTyne.co.uk (“myTyne”) website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. About myTyne

MyTyne.co.uk is a community website providing a directory of local businesses, places, events, area guides, and location community services across Newcastle, Gateshead, Tyne & Wear, and the wider North East.

3. User Accounts and Registration

  • Users must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • One account per person or business entity.
  • You must be at least 13 years old to create an account.

4. Business Directory Listings

4.1 Listing Requirements

  • All business listings must be for legitimate businesses operating in or serving Tyne & Wear and the North East areas we cover.
  • Business information must be accurate and up-to-date.
  • Businesses are responsible for maintaining their own listing information.

4.2 Listing Approval

myTyne reserves the right to approve, reject, edit, or remove any business listing at our sole discretion.

4.3 Third-Party Business Offers and Transactions

IMPORTANT: myTyne is not responsible for any offers, promotions, products, or services provided by third-party businesses listed in our directory. All transactions, disputes, and issues relating to third-party businesses are solely between the user and the respective business. This includes any premium business listings or services processed by our payment processor, Stripe.

4.4 Print Magazine Advertising

Print advertising services (if offered) are subject to separate Print Magazine Advertising Terms & Conditions, which must be agreed to at the time of purchase or booking.

5. Community Guidelines

5.1 Prohibited Content

The following content is strictly prohibited on myTyne:

  • Racist, discriminatory, or hate speech content
  • Homophobic, transphobic, or other LGBTQ+ discriminatory content
  • Content that promotes violence or harassment
  • Sexually explicit or inappropriate material
  • Spam, promotional content, or unsolicited advertising
  • False, misleading, or defamatory information
  • Content that violates any applicable laws
  • Personal attacks or abusive language
  • Content that infringes on intellectual property rights

5.2 Enforcement Policy

  • First Violation: Written warning issued to user.
  • Second Violation: Temporary suspension of posting privileges.
  • Third Violation: Permanent account deletion and ban from services.
  • Severe violations may result in immediate account termination without warning.

5.3 Reporting Violations

Users can report inappropriate content or behaviour by contacting dan@mytyne.co.uk. All reports will be reviewed within 48 hours. Location communities also surface Community Guidelines on each hub page.

6. Content and Intellectual Property

6.1 User-Generated Content

  • Users retain ownership of content they post but grant myTyne a perpetual, royalty-free, worldwide, non-exclusive licence to use, display, reproduce, and distribute such content in connection with the services.
  • Users warrant that their content does not infringe on any third-party rights.
  • myTyne may remove or edit user content at our discretion.

6.2 myTyne Content

All original content, design, and materials created by myTyne remain our exclusive property. Users may not reproduce, distribute, or use our content without written permission.

7. Privacy and Data Protection

We are committed to protecting your privacy. Our collection and use of personal data is governed by our Privacy Policy and our use of tracking technologies is governed by our Cookie Policy. By using our service, you acknowledge you have read and agreed to these policies. We process all personal data in compliance with the UK General Data Protection Regulation (UK GDPR). 8. Limitation of Liability and Disclaimers

8.1 Disclaimer of Warranties

The services are provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. myTyne makes no warranty that the services will be uninterrupted, error-free, or completely secure.

8.2 Service Availability

myTyne makes no warranty that our services will be available at all times. We are not liable for any delays, interruptions, or unavailability of services. We reserve the right to suspend or terminate services for maintenance or other reasons.

8.3 Accuracy of Information

While we strive for accuracy, we cannot guarantee the completeness or accuracy of all information on our website. Users should verify information independently before making decisions based on our content.

8.4 Third-Party Payment Processing

myTyne is not liable for any issues related to payment processing, billing disputes, or payment failures handled by our third-party payment processor (Stripe). Users should contact Stripe directly for payment-related technical issues.

8.5 Third-Party Links and Services

Our website may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of external sites. Use of third-party services is at your own risk.

9. Event Listings and Community Information

9.1 Event Information

Event organizers are responsible for providing accurate event information. myTyne is not responsible for event cancellations, changes, or disputes. Users attend events at their own risk.

9.2 Public Services Information

Information about public services (Post Office, banks, train stations, churches, etc.) is provided for convenience. We recommend verifying hours and services directly with providers. myTyne is not affiliated with any public service providers.

10. Modifications to Terms

myTyne reserves the right to modify these Terms of Service at any time. Users will be notified of significant changes through our website or email. Continued use of our services after changes constitutes acceptance of the modified terms.

11. Fees and Payments

11.1 General Use

Basic use of myTyne services is free for community members. Premium business listings or advertising may incur fees as specified.

11.2 Payment Terms

  • Featured Listings: Payment is due immediately upon purchase via Stripe for featured listings and standard premium services.
  • Custom Packages: For bespoke arrangements (such as multiple location packages), payment terms will be specified in the invoice and must be paid within 30 days of the invoice date.
  • Late payments may result in immediate service suspension or listing removal.
  • We reserve the right to adjust fees with appropriate notice.

11.3 Payment Processing

All payments are processed securely by Stripe, Inc. By making a payment, you agree to Stripe's Terms of Service and Privacy Policy. myTyne does not store or have access to your payment card information.

11.4 Refund Policy

  • Monthly Subscriptions: Refunds are calculated on a pro-rata basis for unused portions of the billing period.
  • Annual Subscriptions: Refunds are calculated as a percentage of the original purchase price, taking into account any discounts that were applied at the time of purchase.
  • Print Advertisements: Non-refundable if cancelled within 7 days prior to the publication cut-off date. Cancellations made more than 7 days before the cut-off date may be eligible for a refund at our discretion.
  • Processing:Refunds are processed through Stripe. Processing timeframes are subject to Stripe's standard refund processing times.
  • Refund Requests: Contact dan@mytyne.co.uk with your account details and reason for the refund request. All refund requests will be reviewed on a case-by-case basis.

12. Account Termination

12.1 User Termination

Users may terminate their account at any time by contacting us. Termination does not relieve users of any outstanding obligations.

12.2 myTyne Termination

We may terminate accounts for violations of these terms. We may suspend or terminate services at our discretion with appropriate notice.

13. Complaints and Disputes

If you have concerns about fees, services, or other issues, you may file a complaint in writing within seven days of the issue arising. Complaints should specify the nature of the concern and desired resolution. Email dan@mytyne.co.uk.

14. Indemnification

You agree to defend, indemnify, and hold harmless MyTyne.co.uk, its affiliates, directors, officers, and employees from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • (a) your use of the services;
  • (b) any content you submit, post, or transmit through the services;
  • (c) your breach of any term of this Agreement; or
  • (d) your violation of any third-party rights, including, without limitation, any intellectual property right, publicity, confidentiality, property, or privacy right.

15. Legal Compliance and Governing Law

15.1 Applicable Law

These terms are governed by English Law.

15.2 Dispute Resolution

Disputes will be resolved through appropriate legal channels in England and Wales. If any provision of these terms is found unenforceable, the remaining provisions remain in effect.

15.3 Consumer Statutory Rights

Nothing in these Terms of Service shall affect the statutory rights of any consumer under applicable UK law, including the Consumer Rights Act 2015.

16. Force Majeure

myTyne will not be liable for any delay or failure to perform any obligation under these Terms due to causes beyond our reasonable control, including, but not limited to, acts of God, war, terrorism, civil disturbances, natural disasters, power outages, and labour disputes.

Posting Guidelines

  • Keep discussions relevant to the local area community.
  • Be respectful and constructive in all interactions.
  • Use clear, descriptive posts.
  • Search existing posts before creating duplicates.
  • One topic per post — avoid combining multiple unrelated subjects.

What You Can Post

What You Cannot Post

  • Commercial advertising (unless in designated areas)
  • Political campaign materials
  • Personal attacks or harassment
  • Spam or repetitive posting
  • Off-topic discussions unrelated to the community
  • Contact information for minors
  • Illegal activities or content

Moderation

  • All posts are subject to moderation.
  • We reserve the right to edit, move, or remove posts.
  • Persistent rule violations will result in posting restrictions.
